A federal judge’s unusual ruling in which he required a Jones Day partner to create and distribute a firm- wide video delineating good discovery practices has been overturned.
U.S. District Judge Mark Bennett had imposed sanctions last year on his own after reviewing depositions during a trial against Abbott Laboratories over allegedly tainted baby formula.
The lawyer, he said, had, among other things, objected multiple times to questions throughout the course of at least two depositions, a practice he objected to.
The federal appeals court, however, rejected the sanctions.
