The death of U.S. Supreme Court Justice Antonin Scalia could potentially affect the outcomes of several labor and employment law cases pending before the high court, employment law professors and other observers told Bloomberg BNA.
Among the cases that could be affected are those pertaining to class certification standards in wage and hour litigation.
Observers told Bloomberg BNA that although Scalia generally has sided with employer positions in previous split court decisions, he had not always done so.
